Synopsis for a guilty plea
Charge #1: Operate motor vehicle without insurance C.A.I.A. 2(1) (a)
Charge #2: Driver-fail to ware complete seatbelt assembly
Date&time: Thu, April 17th,2008, 4:40pm WB Front St. W. at Winsor St.
On Thurthday, April 17th, 2008 at approximately 4:40PM in City of Toronto, in Toronto Region, the defendant, was observed operating a gray 1998 Buick Park Avenue, Ontario marker PPTA324, westbound on Front St.W. at Winsor St.
At this time, the arresting officer observed that the defendant was not properly wearing his seatbelt, as a result of this the driver was directed to pull over and a demand was made for his Drivers Licence, Ownership and Insurance for the motor vehicle.
The defendant produced a valid Ontario Driver's Licence, ownership for the Buick and insurance card for a 2006 Toyota Matrix. Investigation revealed that the vehicle did not have insurance.
The defendant was given the opportunity to have his vehicle towed and was charged accordingly.
----------------------------
I know I am deep . But taking into account the following:
- I drove road-worthy vehicle
- never was involved in accident
- I always drive with care and attantion
- I am 53 and have absolutely clean record during 8 years
- the reason for "No insurance" - was lack of money. I stopped Buick insurance half a year before.
- The Matrix was bought/driven by my daughter (ownership is on me) for money save reason.
- I have very bad financial situation - huge mortgage, negative equity and big (for me) credit line debt (can prove) to bank, which I might not be able to return in this life.
- I re-opened the insurance on Buick in a week after the date
how can I build the defence and what to expect?
Court day is at beginning of Sept. 2008.
Any suggestions please.
