Hicks po po's show no mercy
So here i am minding my own busines, on highway 12 from midland to orillia when an opp cruiser pulls me over. I was doing 116 in an 80 and my license isn't renewed. So i got 2 tickets, the speeding ticket is $271 and the no license ticket is $325. Messed up thing was when i got a couple other tickets in Mississauga i'd be resepctful and the cops would lower the charge, but this yee haw didn't, he gave me the full fine and some lecture on how i'm not responsible. . . BLAH BLAH BLAH ETC. . . . anyways how should i handle this? i already called the traffic ticket experts, has anyone used them? i think their exclusive to barrie/orillia area. It's gonna end up costing me $250 to have them represent me and the worst case scenario is that they reduce the no license ticket to a fail to surrender license which is $110 and drop the speeding to 2 points and i'm guessing around $50-100. This is the worst case scenario, but i just wanna get some input on how good these guys are, i don't know for sure.

You got hit with legit reasons.... Least you could have was renewed your license. So that you could of just taken care of the speeding. Oh well good luck.... Those paralegals work ok... I've talked to plenty before I went to court... And also when I was in court.... They don't do much.. Except dress up like rich folks and use big words... Just go to court.... If your like 90% of people and have to book a day off work to go then I'm gonna be sympathetic towards you cuz I know how it feels....

I live in that area ant the reason they probably weren't leniant was probably because they dont see that much 90/hr is fine but anything over your done. As for the liscence as far as I know that is something almost never seen up here.

So, i've decided what i'm going to do about my situation. Well this came to me at 3am out of nowhere while i was asleep. . . Maybe a dream or something. Anyways, i'm going to Plea Guilty with an explination for the No License ticket, i'll explain how i was never notified by mail of the License renewal and more important i can't afford it because i'm a college student. As for the speeding ticket i'm taking that puppy straight to court, i'm going to delay it as long as possible and hopefully have it dismissed, we'll see what happens. Has anyone been in my situation i need some feedback

The "lisence" one is a "strict liability" offence, so the prosecuter only has the prove that the offence occured to win a conviction... BUT!!!... you can escape conviction if you can demonstrate (via testimony under oath... <"on the stand">) that you acted with an "innocent mind". Your actions were that of a reasonable person. Personally, I beleive that many people would NOT renew their lisence if it weren't for the notice they receive in the mail. Just convince the JP, and you walk

The key is that the prosecution must present documention proving that the method of speed measurement was properly calibrated, and that the testing equipment was ALSO properly calibrated. They only have to show this stuff if you ask for it, so wait 'till the copper's on the stand then ask him for it. Don;t let yourself get tricked in to a continuance so they can get these documents. Demand that they show them now or ask the JP for dismissal.

Hey, thanks for your input it's greatly appreciated. okay i seriously didn't know my license was expired, i never looked at the expiry date, maybe a couple years ago. So yeah i never did recieve notification of it in the mail, i would have renewed it for sure. I got my license back too, oh yeah and it was expired july 27th 2005, so how bad is that for my plea? Anyways i talked to an insurance broker and he said the companies will know that my license wasn't renewed for some time and they'll still charge me as a high risk driver even if i got it lowered to "fail to surrender license" . . . so in terms of insurance what should i do? i think i'm screwed anyways

I think you have to be without a lisence for a full year before Insurance puts you in Facility (expensive), but I could be wrong.
Regardless, plead NOT-GUILTY. If you can afford $100, go down to your local book store and order "The Law of Traffic Offences - by Scott C. Hutchison". You WILL find the sections that relate to your offence and with the applicable Case Law (listed at the bottom of every page), you will have a HUGE advantage at your trial.
I hope you post progress reports....
