I own 99 Sonata, which has developed an oil leak around the valve cover
gasket nearest the firewall. The dealer is says the repair is under warranty
except a "surge gasket". It is my understanding the surge gasket would not
even have to be replaced if it was not for the failure of a covered part?
Does any know is this the case with Hyundai's warranty?

 

What is a "surge gasket"? Do you mean a valve cover gasket? That
would not be covered, it's a wearable item. We need a little more
info, a valve cover leak is not a serious repair, is there more
involved?

Perhpas the "surge gasket" is an upgraded third party valve cover
gasket. I installed such ab "improved gasket" on my Dodge truck when
I could not cure the leak under the valve cover with the stock gasket.

I think I woould disagree. The Hyundai has a 5 year 60,000m bumper to
Bumper warranty and you are in the 5years. As far as a gasket being a
"wearable" item, ask them to show what to wears against? I would say
its under the powertrain warranty 10yr 100000m (the engine is the
powertrain).

It is really easy to replace and should not cost much. You could use
an oil additive the "swells" gaskets so they so leaking. I would lean
away from that though.

Here is some more details: the car was not purchased until November 1999, so
I am certain it still is under warranty. The fact is I have already gotten
the work done. And everything was covered except part #29215-37100 costing
me $19.42. Since everything else was covered why not this item.. This is not
about the money but an attempt to understand why? This part is not a
consumable item. If this can happen where does it end? How good really is
the warranty? (The surge gasket is the gasket that seperates the intake
manifold so repairs can be made on the engine closes to the firewall.) Am I
wrong or right? Either way can someone please explain why?

That number (#29215-37100) is the gasket between the surge tank
and the intake manifold. My guess ( the $19.42 charge ) would be: the
tech did not need to disassemble the surge tank from the manifold to
make the repair, therefore the factory will not allow the warranty
charge. The factory may have allowed a manifold gasket (#28411-37100).
Check your ticket. As the dealer isn't gonna eat the charge - guess
who (whom?) that leaves?

My guess is that the surge gasket was replaced as it was satured with oil,
or because they removed the manifold in order to clean/inspect.oil may have
pooled in some place, and been a firehazard, so the manifold has to be
removed...

So it should be covered , if any of the repair is covered.
