The Pakistani widow and family of Toronto taxi driver Tahir Khan have launched a $2 million lawsuit against the two young men who killed him while speeding up Mount Pleasant Rd. in their parents' Mercedes-Benz cars.
The lawsuit, filed in Ontario Superior Court, claims "extreme grief" and also says that Alexander Ryazanov and ****-Piao Dumani Ross were racing two years ago when they killed the 46-year-old Pakistani immigrant, something their criminal lawyers have denied.
"It's a modern-day Greek tragedy," said Shahzad Siddiqui. He and Russ Howe are legal counsel for the family. "They killed this taxi driver days away from his citizenship ceremony and it's left his wife and his impoverished family."
Last May, Ryazanov and Ross were sentenced to a year's house arrest, followed by a year with a curfew and two years' probation. The 20-year-olds had pleaded guilty to dangerous driving causing death, although the Crown is appealing their sentences.
It was never determined in the young men's criminal proceedings whether they were racing. In a civil trial, the standard for proving would be easier to meet, because it is based on "a balance of probabilities" rather than the tougher standard of "beyond a reasonable doubt" used in criminal trials, Howe confirmed.
Whether or not they were racing is going to be a "huge issue" in the civil suit, Howe added.
Najma Batool, Khan's widow, his mother, Sajjad Fatima, sister Nasira Batool, and brother Shahid Abbas Khan, who live in Rawalpindi, Pakistan, are claiming $2 million in damages.
"The collision has caused extreme grief, emotional upset, pain and suffering," the lawsuit says.
Khan was the family's financial mainstay, paying for medicine for his mother and schooling for his siblings' children, said Mohammad Alam, who is the family's litigation guardian.
Alam, who visited the family six months after the collision, said they were "in pretty bad shape emotionally . . . crying and crying."
Khan's wife and mother particularly wanted to know if he had suffered before he died, Alam said. Khan had planned to sponsor them once he became a citizen, he said.
The family are claiming punitive damages because the young men's conduct was so far from the community norm that it deserves more punishment than the criminal courts have dealt, Howe said.
Khan's family are also suing the drivers' parents – Anthony Ross and Jo-Anne ****, and Sergey and Larissa Ryazanov – alleging they failed to properly maintain their cars and allowed their sons to drive despite failing to properly instruct them how to operate the luxury vehicles.
The claims have not been proven in court.
Justin Linden, lawyer for the Ryazanov family, said it would not be appropriate to comment now. Lawyer Brian Greenspan, who represents Ross in the Crown's sentencing appeal, said the family is in no position to comment.

Yah they said they werent charged with racing which could play a big part in the civil case.
If they actually need money, then I hope they get enough money to put their kids through school, but given the fact that they can afford to hire lawyers I doubt they are in as much "financial need" as they claim to be.

Whatever the way I see it is that they killed the main income for that family. I hope she gets this 2mill, and this case gets closed. Raising two kids by yourself is a hassle, trust me, thats how my family is.
Besides both of those kids that were racing arent poor so Im sure their parents could cough out 2 mill easily.

so what if they are rich? maybe they fake it till they make it and only appear to be rich. maybe they are rich but owe millions on their house, etc... meaning thems just like the rest of us. and if they do have the $$$$, sueing for 2mill might put those 2 families in the poor house ruining more lives.
taxi driver, we all know how they all drive dont we. doesnt he have insurance/company insurance that covers that (death bennifits/loss of earning income/funeral). what about life insurance - accident benifit could have paid out about that much (depending if ya got a good plan or not of course).

then maybe the rich families will sue the car manufacturers for not training their kids or suppling a training video, maybe the widow will sue the car makers, maybe even the dealer, how bout sue the gov for giving these kids licences to begin with.
how bout the 2 rich families sue the widow cuz her husband contributed to mental stress and such, how bout they sue the taxi company? maybe the taxi licensing office?
what if she looses? now she owes a layer and court fee's, plus the rich families might sue her to cover their legal fees

reminds me of what i heard in the news a few weeks back, lady sued the gov cuz she wipped out on black ice and had single car accident, she won 6million. what ever happened to single car accidents are AT FAULT and drive according to conditions.
i wish there was some kind of device that would kill stupid ppl only, quick, someone make a virus that targets IQ's under 80.

just goes to show that all the so called racing is kids in their parents cars and not the people who take the time money and effort to build a nice car..... maybe the government should wake up and smell the coffee....
plus 2 million for the death, if he was the main breadwinner, what have they been doing since and wheres the money coming from for the lawsuit... takes lawyers and they are cheap....

I remember this ****ing thing . I was in the shithole then, i remember talking about it over here .
So why sue for 2 million ? Her husband was a taxidriver ... she should sue them and force them to come over and NOT pay her bills. And then ask her for a tip, and bitch if they don't get a tip.
what other benefits does one get from having a taxi driver in their lives? knowing a person that make slow improper turns in awkward areas ?
